Regarding the sealing of the proceedings from the upcoming hearing, no one has filed a petition to have those sealed yet.

Every week I have to check the new and amended bills that are being released each week in the California state government for a committee I’m on. Today, one proposed bill was suggesting changes to a certain law in the Family Code, and it included a summary of factors that are considered by the court when determining child custody. Here’s the passage:
“Existing law establishes a rebuttable presumption that an award of sole or joint physical or legal custody of a child to a person who has perpetrated domestic violence is detrimental to the best interest of a child and establishes factors to be considered in rebutting that presumption, including that the perpetrator is restrained by a domestic violence prevention order and has, or has not, complied with that order.” (bold text added by me)
In English, this means that, legally, awarding sole or joint legal or physical custody of a child to a perpetrator of domestic violence is presumed to be detrimental to that child, and this is a factor the court will consider when determining custody. However, the parent who has committed domestic violence is able to overcome this presumption in court (this is what is meant by “rebuttable presumption”) by giving evidence regarding certain factors to be considered, which may defeat the presumption. Unfortunately for Alice, two of the factors used to rebut the presumption are: (i) whether she is restrained by a domestic violence prevention order (she is); and (ii) whether she has complied with that domestic violence prevention order (she hasn’t).

I hope the girls have been open and honest in evaluations and therapy and that they feel they can trust and speak to those evaluating them so an accurate and truthful picture is presented rather than them Being schooled by Alice in their answers (I’m sure Dupee sees this all the time and knows how to get to the truth).Thanks for this. Popping in to agree and to say the DSM is very influenced by pharmaceutically-defined concepts too, and some existing disorders in it are ridiculous. For example things like ‘Oppositional defiant disorder’ which is a completely nebulous concept which mainly just stigmatises traumatised kids who are acting out. It can also be dangerous and influence medical professionals to merely drug them into submission rather than to listen and understand that their actions might be a needed coping strategy, or logical response to their experiences.Looking at the ICD11 classification and description for CPTSD and how it fits alongside PTSD, it looks short but clear. For diagnosis, I would always have a preference for ICD/WHO over DSM/APA. Not ragging on the Americans here, but DSM just seems like an immovable beast sometimes. DSM I gather does look to ICD to some extent at least so I suspect CPTSD will end up there too.

I don’t think it really matters if the children provide distorted versions of events. Any evaluator worth their salt will triangulate with other sources of information. The fact that they are being fed lies is the problem. The evaluator won’t challenge their statements but will gently probe and use other forms of questions to get to see things how they are. Things are likely to be very mixed up in their minds. That’s a red flag and something that needs to be uncovered.This is the challenge isn’t it. Just because someone's not a good person, doesn't mean they can't be suffering from bad health.Re: Alice, despite her awful behaviour I’m not convinced it’s true that everything she has is made up, and it’s not as easy as one might think to get any form of diagnosis. People can be jerks and have experienced trauma in early life and/or have real undiagnosed conditions; the two things aren’t necessarily mutually exclusive.
