She has to return after her maternity leave else she'll have to pay it all back. Minimum she has to do is 3 months then she can move on. It’s always been a thing with regard to company maternity pay. You are entitled to keep statutory maternity pay if you qualify for it but most companies who make your pay up above SMP levels or pay beyond the statutory period require a commitment that you are returning to work at the end of your mat leave.
