Ioan could try for an emergency order for custody. All the evidence of emotional abuse, PA, ongoing DVRO violations. It's all right there. I've said before I understand the methodical approach and how Ioan, especially as a male, has to provide an extreme amount of evidence/proof. It's enough. There's enough abuse for the entire world to see. Whatever is happening behind closed doors is likely worse.

I hope his lawyer earns her 500 an hour! He has been so patient with this legal process but I would have been losing my tit by now. Patience of a saint, but it just seems like this drawn-out process is causing irreparable harm.
Honestly makes you lose what little faith you have in the legal system.

Between interfering in therapy, phone calls and visitations, pulling her kids out of school (or at least one), the PA, the abuse, interfering with his earning ability, trying to sell the house, her stymieing every aspect of this divorce, the DVRO, the violations, the refusal to work or put any effort into providing in any meaningful way for her children’s emotional and basic needs etc…there is no judge in the state of California who will allow her to have any custody, even supervised unless she does meaningful work (rehab, parenting and battery courses, therapy). Settling on 50-50 was her best hope. Going in front of a judge means it’s all over for her custody wise. My firm, firm opinion.

Alice has filed to delay the Feb. 15 custody hearing. She claims it may violate her right to self-incrimination if they don't wait until after the disposition of the criminal case. Anne responded in an email that they intend to oppose this motion for continuance.

She had a public defender appointed (with her assets, don't know how that was possible) and he says the trial is set for March 14 and will last 6-10 days.

Thank you so much @ButterTart for clarifying this. There are way more twists and turns to come before this nonsense ends. Poor girls, poor Ioan, and poor Bianca. I think the Abuser will end up a lot poorer living a very different life, if not in jail.

Alice may be a bleep alienating her children but she is the only long term presence the children have had for years, what with Ioan being away working and then the PA. The courts don't rule in favour of the parents but the children, and sometimes the ruling is unfair as the children, especially Ella, may never recover from the PA and have a relationship with their father. The risk of harm to the child (running away, self harm) is too high
