Yep, exactly what I'm expecting him to get. Justice system in this country is a bleeping joke. People that deserve prison don't get it because prisons are overcrowded. There's enough bleeping houses and flats being built, how about more prisons? Why should a criminal, especially one that's committed sexual offences, be allowed to walk free because there's no room?! It gives out the wrong message...sex offenders get away with a slap on the wrist! And any punishment that doesn't involve prison that they DO get handed is dressed up as rehabilitation and prison not being beneficial towards that rehabilitation. Absolute bollocks.

And a lot of judges are still stuck in the past and don't realise what effect crimes of a sexual and/or abusive nature has on their victims. Those of you that "know" me, know why I feel so strongly on the subject, and that I WILL speak out about it. It's a disgrace. He's not going to prison and he bleeping knows it.

I posted the sentencing guidelines that the judge will use on a different thread. The mitigating/aggravating factors lean towards custodial but you never can guess how these things will turn out.

I am not a lawyer, but I have a vague (as good as it gets in the enforcement side) idea how these things play out.

1) He pleaded NG. So loses any discount at sentencing
2) He will turn up and give it his best Ali G, which will not impress the bench
3) IF he is representing himself, see point 2
4) On conviction he will become a Registered Sex Offender and subject to all the restrictions that follow. This is a PERSONAL view, but he cops a suspended/community order and it will actually be worse. If hes locked up, the restrictions on life that come with being an RSO wont affect him. I posted a fairly detailed breakdown of the joys that await him. Im sure more learned members can find it as I'm f*cked if I can
5) He gets a suspended sentence, I would guess he’ll breach it in about 15 minutes
6) He’s an utter spunktrumpet

Ultimately, the outlook is not good however it is disposed of

It will be a CPS barrister as representative for the Crown (R v Bear as it will appear). The victim will be a/the prosecution witness. My one abiding hope is that he pleads guilty before they start otherwise IF he's representing himself he would be able to cross examine her. Yes its a fucked system before anyone states the obvious.

Offences like this wherever my team deal with them across Europe are “niche” so is likely to be a specialist in field

He'll definitely be going on there, anyone who's been found guilty of a sexual offence...and it specifically mentions "including revenge porn" will be put on it, that's a given and it the only part I'm actually glad about him receiving because it's going to cause him all sorts of issues. I can guarantee that if he gets a community order he'll be making a joke out of it. Like it's something to be proud of cos he thinks he's a hardened criminal

I did see a few of your posts and they were a brilliant insight from someone (you) that has more knowledge than the average person.

I'm kind of biased on our justice system because it's let me down badly, twice. One plead guilty and pretty much walked away, the other plead not guilty and I had to go through the trial. He had a history of violence as long as his arm, the offences he was charged with against me he still had a tag on his ankle for doing the same to his ex, he was charged with GBH and he'd served 4 months on remand while awaiting the trial. He got 8 months DESPITE his criminal record and the tag, and walked away from court because of the 4 months he'd served on remand.

How I ended up with someone like him is irrelevant and also a very long story, however, being that 20 years on I still look over my shoulder and I still think of how he robbed me of the chance to have children and how I will never trust anyone 100% again, especially after the most recent one 18 months ago who was also an absolute headcase that didn't at first seem as such (classic love bombing for the first few months) , I have no faith in the system. I have absolutely nobody in my life except my work colleagues and my parents because I will NEVER let anyone get anywhere near me ever again. I spend my evenings and weekends alone, doing the same thing every single night and evening because I'm scared of breaking routine. I'm going off point now, but it does come around and finish up on my point that judges when sentencing have no idea how these dregs of society affect their victims.

It is very much a lottery whichever country the case is in im afraid. Too much political point scoring, lack of investment and people in positions of power not having the bleeping clue what they are doing.

The ONE upside in his case is the 2003 notification he will be subject to.

But they have a list of what they can and cant do, decided by politicians and have to work with that. I could not (nor am I clever enough) do their job.

You can never know how things go. I’ve read about someone who was sentenced for voyeurism (recorded images of friend changing and using bathroom found on laptop) and child porn also saved on laptop. This individual only got a community order.

I think he'd end up breaching something, he's far too cocky and thinks he's above rules. The curfew option wouldn't affect him as he doesn't go anywhere. If he gets community service, I do wonder where probation would place him?

The annoying thing is that even if he gets convicted, if he walks away without a jail sentence he will leave acting like he’s won!
Will the court take into account all the mocking he’s done online?
Personally I’m hoping he’ll turn up in one of his chav ensembles so that the judge will take one look at him and silently decide to stick him in jail on the basis of personal dislike!
