I'm not sure that's how it works though.. the burden of proof is definitely different but I'm still not sure they have to prove an alternative theory, I don't think its a case of who more likely killed John.. Karen or Higgins? But taking all of the evidence into account is it more likely than not that John was killed by Karen Read's car. If that makes sense!

Court TV are going to be streaming the civil trial, if pre trial becomes heated they’ll stream that too.
Turtleboy has been posting snippets of Bederow’s mega motion filed last week. I was wondering if the redacted parts will come out during the civil trial. These in particular are intriguing

I’m not sure if there was any sort of rumblings before it but Howie Carr said Karen Read was going on his show with AJ for an interview. People got upset on TB’s behalf as they felt she owed him the first interview. TB said KR had said she was just popping her head in to say hello. TB had asked Howie Carr to join the interview and he said it wouldn’t work out with timings.
It turned out she spoke for a good few minutes. Then HC’s producer and TB got into a twitter spat, TB said he wasn’t going back on HC’s show ever again.
After that there had been some kinda comments made as TB would sarcastically say KR made him (or something to that effect I can’t remember the exact wording). TB also said he got some “not nice” text from KR the day after his show at the Wilbur.
TB had some problems in his legal team, an account for a long time was targeting his girlfriend Meredith O’Neil and it turned out to be run by a friend of TB’s lawyer’s paralegal. There’s a whole drama around that.
One of KR’s supporters, Olivia, joined TB’s team to help with Bederow’s “mega motion”. Olivia had some sort of online situationship with another FKR person from twitter called Joe Flipperhead. It cooled off, wasn’t talked about.
Not sure what kicked it off - it seems like maybe a football rivalry - but PurpleKoolAid and Joe Flipperhead started arguing and it’s alleged he said Olivia was catfishing him, wouldn’t cam up for 3 months, he went bonkers and contacted her family saying she was dead and her sister in law was impersonating her.
Bederow & TB had a teams or zoom call with her where she cammed up so they told JF she was actually real and he accused Bederow of now being in on the catfish.
Ultimately this lead to Joe Flipperhead sharing screenshots of texts meant to be from KR saying that she had fallen out with TB as someone sent a 30 min recording of their conversation to one of her attorneys. TB denied it but has also said it’s the same text he got after the Wilbur show.
Sean on the gulf, notoriously unreliable former DEA agent posted a clip with a recording but it’s weird and sounds like it’s put together from her angry voicemails.
That’s as much as I know, don’t know if they’ve figured out who is lying or not. I’ll add links to the twitter bits below;

Thank you so much for that. Will be interesting to see how this all plays out. I assume Karen Read and her team have cut all ties with TB now. Sounds like he's going to be a big part of the civil case though

I thought Karen had taken a step back from everything because of the civil case. On the first day of court for the civil case, the O'Keefe's attorney stood up and said how Karen had hit John with her car and that she fed info to Turtleboy etc. So it seems logical to stay away from him. The prosecutor in TB's case was also going after Karen's phone until he removed himself from the case last week.
From what I understand the bar of what's admissible is much lower in the civil case and Karen will be deposed so I guess it's a case of fueling the fire as little as possible.
I've been out of the loop for a bit, but wow, still, things are crazy.
The fallout from this new batch of texts from Proctor is gonna be big.

Lindsey Gaetani who was TB’s accuser has herself mixed up in all kinds of mess. It had to be dropped because she sued Cosgrove and Mello was a witness as he was on the phone while the alleged incident happened. She’s just doxxed Michael Morrissey’s phone number on X now too.
Proctor’s texts will be interesting. I saw some people saying they hope there’s a picture of the tail light before the car was in the sally port

No. I think she did hit John but the investigation was compromised from the get go (needing to warm him up before they could confirm he was dead meaning the police didn't actually have the experience to collect evidence and a problematic lead investigator). I understand the not guilty verdict but I still think she did it. I hope the family win the civil case. The niece and nephew have been through hell in their short lives losing three parental figures in tragic circumstances.Am I really evil for hoping she has some kind of comeuppance?

Proctor is alleged to have sent a text to a cop from canton saying there was no need to visit a scene because it was "just a dirty (racial slur) and I hope he dies"
There was also a chat with "pictures of intimate body parts of people not involved in the chat" and the name of a sexual assault victim.
