Has much been mentioned about the uncle? I can't quite work out that relationship. There is quite an age gap, between him and US, so I wouldn't have thought they were close. Surely he must have been a willing party, otherwise you'd have hightailed it out of there when it all kicked off and found his own place.

I think he worked in McDonald's and probably didn't earn much money. Rents are expensive and it's not easy finding a place.

So perhaps the easy option/the option that made the most financial sense was for him was to stay there.

He was involved in the JW of Sara's body so I think it can be surmised that he knew about some of the abuse but there isn't much evidence to suggest he knew everything.

If the prosecution claim he was there when the fatal injury was inflicted and didn’t intervene then that would place him above BB’s sister in terms of C/AD but if he was out of the house most of the day and night and wasn’t there for that (or they can’t say either way) then really, how can the CPS justify prosecuting him and not BB’s sister who likely knew far more.

I’m not saying the jw part isn’t horrific and he should be punished for his role in that if nothing else but if she was already gone, it’s not C/AD is it?

This is why I'm surprised he hasn't taken the stand, if he was out of the house a lot, his McDonald's rotas would prove that but not taking the stand means that the jury never hears this defence. I'd say in absence of evidence they need to say not guilty but every bone in my body says if he hasn't presented a defence he's guilty as hell

It was reported that the brother had 91% attendance at Portsmouth University, yet he was living with the family in Woking, that is a 90 min train journey each way. Was he a part-time student? He also worked shifts at MacDonalds.
Whatever time he spent in that house, I doubt he was ignorant of what was going on.

In 2022 I would imagine a lot would be online. A lot of degrees have very low contact time too, maybe 15 hours a week.

The thing linking the uncle to Sara's abuse is the fact that his DNA was found on both ends of the cricket bat and belt which also had Sara and US's DNA on both ends. The cricket bat fit a number of old and new injuries so it is highly probable that the uncle beat Sara as well. There is no other logical explanation for his DNA being found on both items. The prosecution also said that both the uncle and BB would message or call US to tell him of Sara's misbehaving knowing that he would come back and beat her.

He's as guilty as BB in my opinion even though US tried to shield him by saying that he had knowledge of what happened to Sara. That's impossible living in such a small house. It was said during US's evidence that at one point FM had offered to take the blame for everything; it's not clear to me at what point he did this and how the prosecution know. He might get a lower sentence simply because he wasn't in the same position of parental responsibility, but I would be very surprised, and disappointed, if he isn't found guilty of murder along with BB.

He could have taken the stand and argued he played cricket with the kids, accounting for his DNA but he didn’t. Also US gave him a get-out on the belt, saying they shared clothing- he’s a proven liar about everything else so I don’t know if the jury would buy this. FM is not a stupid man- he studied at uni and held down a job. He’s also not so timid if he can travel to a foreign country and make a life there. He knew it was wrong otherwise why offer to take the blame? It will come down to what anyone could be reasonably expected to do in such a situation- can they prove beyond reasonable doubt he knew Sara was being deliberately caused serious harm? If the jury believes he was aware then he would be expected to do something. I don’t know if it matters whether he was there around the time she died if he knew what was happening prior to that, if the case is she died from the cumulative effects of sustained abuse. The judge will explain it all in directions to the jury- the things they must be sure of and how they relate to the charges put to him. Sorry for rambling, I just want to understand how it’s going to play out so I can be hopeful they all get murder convictions.

Edited to add. I think it’s a narc/ego thing that has made US claim full responsibility. Like “I’m not having MY wife and brother punished over what happened…Aren’t I so noble shielding them from the blame…People will believe me because I’ve cried tears on the stand…I didn’t want her to die, so I’m not a murderer…” etc etc

Yes I’m hoping the judges directions are very clear, you have one person who agrees he is a liar and two people who’ve said nothing, all three fled the country and chucked their phones.
Sara had old injuries, she’d had broken bones over months, maybe years. Faisal knew exactly what was going on.

They have good points, if I was on trial for a murder and I hadn't done anything wrong I would be on that stand defending myself. Maybe his lawyer advised him not too but he's painted in a bad light because he can't have lived there that long and not noticed anything.

Of all of them Fasail has the most plausible deniabilty. He was at work ir in uni, he could argue that he would only come home to bathe and sleep ..so why wouldn't he present a defence, rather than face a lengthy prison term.

There must have been more evidence than can be reported at this stage.

It will be interesting to see what comes out after sentencing.
