Sorry to quote myself too but ASA aren't really the big scary people either, we never really focus on ASA, though we do try to adhere to their guidelines because it just makes life easier. It's more GDPR would be the big boogieman of marketing/advertising & along with Ofcom. They would be the ones we HAVE to adhere to 100%. They are the ones who you do NOT want knocking your door ASA will drag you do court if you f*CK up & they're 100% sure that without a doubt you're wrong, and likely do a case study on you on their website, but GDPR guidelines are not to be fucked with even more and Ofcom too, so they would be the big fears of marketing/advertising. Prob an eye roll at an Email from ASA but if it's gdpr related or directly from Ofcom email then it's full on all hands on deck & crisis & panic mode.A few asking why she's not tagging ads when she should.
There's alot of research that shows that audiences disengage, cognitively, when they see ad, alot of the time without even realizing they're disengaging. Eye tracking, clicks, purchases etc have shown advertising materials aren't as fruitful as ads appearing to be "organic" i.e dressed as if they're not ads. Sort of like when you Google something, like a shop for example, research shows you are far less likely to click on the first result marked as "ad" even tho technically it gives the same outcome as clicking one that doesn't say "ad". The one without ad is more trustworthy & genuine seeming. I'd bet that's why she's not marking as ad.
