Let me catch my breath from sprinting directly to this thread! We’ve been wondering if this would be a possibility and now here we are. God bless the police for this. Even if it doesn’t result in convictions it’s so satisfying to know they will be sweating over it. To know that people actually SEE them for what they are and that we understand what they have done by defending, befriending and enabling this pos. I just knew the braindeads would jump to the wrong conclusion and think this is to exonerate Letby and place the blame on hospital failings even though the police statement explicitly says it’s about not stopping her sooner.

I suspect that Letby being a convicted murderer will end up being an agreed fact even by the defence if manslaughter charges went to trial. As that’s what it is - legal fact - regardless of what anyone else thinks. Not an opportunity to hijack it for a Letby appeal FFS

Liz and Caroline have released a new episode about the latest investigation. They have Mary Prior KC on who explains what ‘gross negligence’ means in law. It’s interesting. I do think it will be a challenge to prosecute but I’m just happy a few of them will be sweating now. They obviously don’t discuss individuals as it’s a live investigation.

the problem for the managers is that they did eventually remove Letby from patient contact on the strength of no more evidence than further deaths - so if they could removed her then why not before?

Yes they would have to explain why did they see a risk then but not sooner - they were waiting for more incidents to happen to see if they were still linked with her?!
I’ve just extracted from the podcast transcript where Mary Prior KC explains the ‘gross negligence’ bit. I think I find this far more reassuring for the consultants because they didn’t have the power to remove Letby from the unit and that wasn’t their job to do. I think it would be hard to prove that if they had gone over the exec and reported to the police sooner it would have prevented specific deaths. Because the exec still had the power to decide what to do with her, like we saw once police investigation started anyway and she was still working and not suspended!

This explains a lot actually. The rush for the Decemebr and February press conference and submission to CCRC. He’s desperate for the inquiry to be paused because it’s not going to make his client look good! I wonder if he’s actually submitted the full report to CCRC yet as the Feb conference said it would be in the next month. I don’t think this would be enough to pause it. If it got returned to appeal courts before the autumn then maybe she will delay her report release but can’t see that happening either.
This is the bit that will have them sweating. They were told there were suspicions that she was deliberately harming babies. I think it will boil down to the timeline of when the concerns were documented vs when she was moved. Also if anyone presented with the concerns and evidence available at the time would be reasonably expected to act on those concerns, I’m not sure whether that would be expected to be in their professional capacity (probably a civil matter) or to go to the police. As someone has pointed out, there was no conviction for baby Q so saying you would personally take responsibility for any problems probably couldn’t be considered. I’m not saying any names as I read that they aren’t releasing names just yet in case there’s a trial, but everyone involved is already in the public domain anyway.
There's absolutely no way the Inquiry will be paused. There's no bar to be reached for a CCRC application to be made - anyone convicted and already appealed can do it at any time and the mere fact of making an application is no indication whatsoever of the strength of the case. In any case the CCRC were getting ready for this application months ago so they were already involved.
