Yes the Gardai send what evidence they have to the DPP and they decide whether or not to prosecute, it depends on how confident the DPP are that they will get a prosecution.Does the dpp decide to prosecute then or something is it? Is it the guards didn't have enough evidence that she was let go?

Yeah I'd be thinking/hoping the fact they're preparing a file for the DPP then they feel they have a good chance at a prosecutionIt’s standard enough procedure. The DPP makes the call now, the fact that she was arrested tells me they will prosecute her.
