Her solicitors may well have brought up the issue of capacity as the trial got closer. Although I suspect the potential of her being deemed unfit for trial, would expose all of the things she didn't want to have exposed.

Her fitness for trial would have already been established by the CPS prior to the decision to charge being made.
It has been reported that she received medical attention during her time in police custody, and at this point she would've been assessed. If there was a suggestion made that she was unfit for trial (unlikely as problems have to be quite bad) they would've checked this before charging.
It is possible that the defence would have referred to her mental health problems as mitigating circumstances.

I think it’s a little strange that some people are saying ‘see Caroline said it was an accident, I can’t believe it was being pursued in court/it’s so dreadful she couldn’t defend herself’ etc.

firstly CF was reportedly off her face that night on alcohol and drugs. Her memories of exactly what happened are likely not that reliable. Secondly it’s fairly natural for people to shy away from uncomfortable actions, and convince themselves of a more defensible version of events. Not to mention that when sober I’m sure she absolutely regretted her actions, so it’s easy to say it was an ‘accident’ as in, something she would not have done in her right mind. Thirdly, even if she knew deep down that she was responsible, it’s still in her interests to minimise the situation and put out a version of events that paints her in a better light.

Ultimately the truth is unlikely to ever come out now, but I don’t think Caroline saying she’s innocent is likely to be the most credible version of events. I doubt the CPS would have continued to pursue a conviction without very solid evidence that this was more than just ‘an accident’.

Where did you find out that she was "off her face" . I haven't seen that anywhere?

The CPS don’t release evidence to the press prior to a trial, only to the defence solicitor. They are also very careful about what they release post trial.

He’s usually very quiet about his private life but with it being such a recent thing, his close and well known connection and the fact he has a song on his new album called ‘treat people with kindness’ I think he might at least allude...

The results of the CPS investigation are likely going to reveal that there was sufficient grounds to prosecute and there might even be a few unsavoury facts about her behaviour that night thrown in to support this. It’s not going to do anything to soothe the “she should have been treated differently because she was a woman”, brigade.

The CPS know what they’re doing.

We will never know... The CPS said they would not release to the public their conclusion after the investigation.

If LB did post the photo (I don’t know if he did or not), I wonder if he did so purposely to compromise the trial? Seeing as he wanted the charges dropped, maybe he was trying to have anything declared a mistrial

I’ve been puzzling over this too, did he post it before or after it appeared online do we know? If he posted it before he was obviously doing so to negate the deal done with the newspaper by whomever was at the scene as CF said it had been sold so maybe she had been tipped off by her ‘friend’ DW.

They’d tried to appeal it, to quote an article I read earlier

‘As for the role of the CPS, I find it hard to swallow the suggestion that it should have dropped the charges against her. I know how hard Caroline and her team tried to make this happen. They even went as far as to write to the Attorney General’

I don’t think that you can appeal against a case being sent for trial. Perhaps the defence were trying to get an adjournment due to her fragile mental state?

My guess would be that she’s thrown a lamp at a wall or something and a small shard has bounced off and cut him or something along those lines. I believe she didn’t ‘whack him over the head whilst sleeping’ and let’s be honest a lot of us have probably thrown something when angry. We aren’t all angels

why has dan wooton only just released the image showing her boyfriends tiny cut now. He could have released it before instead of showing blood all over a room and letting people assume it belonged to Lewis. All very sad, but dan wooton going back and removing articles he allowed to be published doesn’t make the public forget he did it

this whole thing has bothered me all week and shows that we shouldn’t believe every spin the press put on things

He’s probably only released it now because he wouldn’t have been able to do it whilst it would have been shown in court as evidence. And let’s face it, that pig has probably been sat on that pic for a while now

He's said don't worry about him and he has the love of his girlfriend and close friends around him.

I think he's feeling a lot of guilt and rightly so. He more or less admits he put out that stuff about the NDA as he wanted to hurt her like she had hurt him and I don't think he means hurt in the physical sense but emotionally.

His blog was rambling..one minute blaming Journalists, the next the press, her management, her PR, the public then back to blaming himself.
