There was a case years ago and the alleged rapist defended himself. He was able to cross examine the poor girl and did so for days.
I think the law was changed after that.
I wish I could remember more details but I was just so appalled disgusted sad and angry that it was allowed to happen in the first place.
That is truly awful - and they wonder why rape/sexual assault victims donā€™t come forward.

You canā€™t defend yourself on any sexual charge in Scotland and I hope revenge porn/voyeurism comes into that too

Hopefully the judge also looks at the possibility of him doing it again in the future. How dangerous he is to women, the public, children etc. He makes a lot of people feel uncomfortable and where ever he is, he will always attract drama and attention. They also have to look at his mental health, is he fit enough mentally to be in society? Does he pose a risk due to his delusions? I hope girls come forward and speak up, he really deserves to be locked up where the big boys will teach him a lesson :)

I honestly know nothing about him other than heā€™s the Godfather of twit, but has he been convicted of anything before? I donā€™t even know what charge heā€™s facing but if a Judge can give a custodial sentence for it then he might go to jail. But unless English law is different to Scottish law in this regard, then the Judge wonā€™t be able to consider anything else other than the facts of the case (happy to be corrected) and his previous offending history, especially if he has similar convictions. This is of course if heā€™s found guilty, which from what the other posters have says, thereā€™s plenty of evidence.

And again this might be different under English law but in Scotland, if someone has a jury trial and they have previous occasions then the jury only know about them after the verdict has been recorded. So a jury will be ordered to disregard anything they know about him already and give their verdict based solely on the facts presented.

But I donā€™t think we should bank on him going to jail unless the charge has a tariff of automatic jail time or he has similar convictions. The Judge could of course wants to make a high profile example of him (which hopefully they will)
Its pretty much revenge porn he has been charged with and it has been sent to Crown Court as the sentence that comes with it if found guilty is longer than 2 years.

It will be trial by Jury and he may not get found guilty. What concerns me is that the Jury will be told to ignore anything that appears in papers etc in order to reach an unbiased decision.

If found guilty, he can be sentenced anything up to 2 years and I think it could be suspended too (so if reoffends within that period, he gets sent down automatically to serve the rest of the time in prison) I think its his first offence of this nature that he has been tried for so could very well be a suspended sentence unless the Judge considers him a risk.

Of course we dont know exactly what evidence there is on G's side or if any other girls have come forward with supporting evidence and statements of similar.

The only evidence used will be everything that G has provided to her Solicitors and they can't use any of this stuff that been going on unless it specifically has a link to G or mentions her by name or can prove its related to the case (I think...)

If found not guilty, he walks away.

I donā€™t doubt that he will be found guilty (but can you imagine the arrogance off him if he wasnā€™t!!)) just donā€™t think he will receive a prison sentence. At best community service or he will be in and out within a month.

Iā€™ve never wanted to get called for jury duty more. Iā€™m in the wrong county but I can dream!

And I suppose one positive of a big gap between now and the trial is that other victims/witnesses may come forward too - Iā€™d be surprised if he hasnā€™t done anything criminal to any other female

If trial by jury, it'll be hard to find him not guilty. If I was a juror I'd be hard pushed not to find him guilty based on his behaviour. I understand that it should only be based on facts and evidence for the particular charge and anything else is deemed irrelevant but........................

I wonder will he go the route of not being able to get a fair trial over media coverage? or use MH which wouldn't be beyond him. If he's representing himself, then I also wonder about the lack of intelligence, so that would be good as he thinks he's above the law. Pure sociopath!
Hopefully heā€™ll have a tit lawyer (hope heā€™s not getting Legal Aid if heā€™s a millionaireā€¦) who doesnā€™t reign in his behaviour and he repels the jury rather than charms them (as I suspect he thinks he will)

But thatā€™s the thing, the Judge canā€™t take that into consideration unless it forms part of the prosecution case and there are charges on the Indictment, and if heā€™s convicted of these charges. They canā€™t add time to someoneā€™s sentence in case they reoffend and similarly with the mental health thing, if heā€™s mentally ill ā€˜enoughā€™ (for want of a better term) he could go to an appropriate facility, but I would imagine there would be extremely tight criteria for that.

I would be very surprised if any Crown Court Judge has heard of him and in the same way a jury is told to forget anything they know, the judge canā€™t research him beforehand either so the Judge is probably the one person there who will be acting on what was seen and heard in Court.

I too believe he will be found guilty. He'll be put on sex offenders register?

Heā€™s handsome when he keeps his mouth shut but itā€™s a whole different story when he starts whining in his Frank Spencer voice.

I hate myself for watching his stories at this point but I canā€™t help it now šŸ™ˆ He is surely off his nut on something going on about the bleeping dog calling it a cat then staggering up the beach shouting out ā€œIā€™m Rich!ā€ I hope he gets robbed.
Itā€™s like a car crash though, you canā€™t help but watch. I feel exactly the same, I hate that Iā€™m giving his page traffic, but I canā€™t help watching so I can hate him even more

Youā€™re right, thereā€™s now laws against this for sexual offences and domestic abuse.

I actually donā€™t think he will be bothered either way how his case goes. If he gets off, nothing will change in his behaviour. If he gets a few months in prison, heā€™ll go in with his big persona and make himself liked and laddy. Maybe do a bit of networking. titā€¦heā€™ll prob try and get a tv deal/documentary out of - ā€œStephen Bear: A Celebā€™s life Inside Britainā€™s Toughest Prisonā€. Heā€™s such a piece of work.

I was just thinking about this! The absolute chip heā€™d get on his shoulder if he isnā€™t charged. No doubt heā€™ll come out and state G was lying etc. it would be absolutely awful for her to have to deal with I really feel for her. Seriously hoping heā€™s charged and locked up, might knock him down a few pegs but then again Iā€™m doubtful of that too

Heā€™s been charged, he appeared to plead. How can she lie when the evidence is all over the web?
