How has that a baring on the case if it's only evidence based ? that may sway a witness but I can't see how it has any baring on a jury when they can only reach a verdict through evidence.Literally again, we agree that juries are meant to judge on what is in front of them but it cannot be guaranteed if newspapers say this or that, or some random social media post from an online person who claims to know the alleged says something that isn't mentioned in court
I don't mean to sound rude, but I do know how jury service normally works
Because it could be argued that a person did not receive a fair trial, if the jury were influenced by what they had read or seen onlineHow has that a baring on the case if it's only evidence based ?

Yes I sat on a jury of a case that was written about widely in the media in NI, speculation on social media etc but it was made clear many times by the judge that only evidence presented in the court could be considered when returning a verdict.I've sat on a jury it's not as straightforward as people think that's why the police will be gathering as much evidence as they can so he will be found guilty without any reasonable doubt ,the verdict is only based on the evidence you have in front of you, personal opinions are irrelevant if there's no evidence to back them up .
This has set me off again, I literally think about her all the time. I hope he makes it prison and gets brutally beaten day and night , karma please catch up with him
My main email address is Hotmail. I’m such a dinosaurMaybe I’m on my own here but I didn’t even know they were still a thing!![]()
Yes the one I sat on the person had many convictions for the same offence well documented in the press but we couldn't convict them on this instance because the evidence wasn't enough.Yes I sat on a jury of a case that was written about widely in the media in NI, speculation on social media etc but it was made clear many times by the judge that only evidence presented in the court could be considered when returning a verdict.
Almost every female in the U.K. has written an opinion on this on the internet. We aren’t involved in the case, they are opinions, they aren’t going to affect anything. It’s all in the language used - the news outlets will only report the factual details of who has been arrested and what for. Nowhere will you find them printing anything that assumes guilt. Innocent until proven guilty. Once PROVEN guilty in a court of law then that’s different. We all have our opinions, of course, my point is that no one should be airing them on here, a public forum, and you can get in trouble for doing so. I mean that’s aside from the fact that is grossly disrespectful to the family to speculate on details anyway.
Yes that can happen, and has happened.
But what I'm saying is the judge only accepts hard evidence not speculation. I think a witness could be swayed by what they read about a perpetrator but a jury can't be biased as it evidence based .Because you cannot guarantee that people will only look at the evidence before them, as much as the legal system would like to do that
It's why the news should only report confirmed facts released by the police/courts, and why people shouldn't talk about something as if they know it happened that way. It's great that you only consider the actual facts before you, but many people would be influenced by stuff beyond their personal opinions on what happened
Thinking through it, speculation really does fall into a weird place in all of this
And you won’t believe it but that could have been seen as unfair trial because prior convictions shouldn’t be discussed by the press really as they could tarnish the character of the allegedYes the one I sat on the person had many convictions for the same offence well documented in the press but we couldn't convict them on this instance because the evidence wasn't enough.

They weren't discussed I saw his name a few weeks after the trial for the same offence ,that's what I mean when I say only the evidence can lead to a conviction. And you won’t believe it but that could have been seen as unfair trial because prior convictions shouldn’t be discussed by the press really as they could tarnish the character of the alleged
Someone linked a whole article on this and it discusses a few cases
And tired of being lectured to about this, it feels like another control over women doesn’t it? Under the pretext of ‘rules’.Almost every female in the U.K. has written an opinion on this on the internet. We aren’t involved in the case, they are opinions, they aren’t going to affect anything.
The judge would put a blanket ban on all reporting of the case .Also the things is everyone will have opinion on the case because it’s been in the NATIONAL news, can’t say a lot of people will come here for it, I would say most of us use other things, plus judges decide what can and can’t be used so![]()
There's a murder case atm, the young woman from Derry who was murdered by her sister's boyfriend. He tried to pass it off as suicide, he took her to hospital alive and told doctors he found her hanging but they alerted police as they were suspicious of the way he was behaving and the fact that she had no ligature marks. Evidence on her phone suggests she was in a coercive relationship with him, she had text her new boyfriend saying if he (the suspect) ever found about them he'd kill her. This has all been documented in the papers and countless comments about it on social media and it hasn't reached trial yet.Yes the one I sat on the person had many convictions for the same offence well documented in the press but we couldn't convict them on this instance because the evidence wasn't enough.
That’s quite gaslighting don’t you think? As if I don’t because I object to people policing other people on this thread? The law applies to everyone. It's so Sarah's family can get justice. Don't you want that?
Yeah very familiar with those cases that guy's a complete animal .There's a murder case atm, the young woman from Derry who was murdered by her sister's boyfriend. Also the identities of "Boy A" and "Boy B" in the Ana Kriegel case in Ireland were meant to be protected because of their age but their names and photos were exposed on social media before the trial. We knew that one of them was the son a guard (police officer). We knew they were intelligent, we knew they were "baby faced" and looked younger than their age. All reported in the press. They were found guilty, Boy A got life, Boy B, 15 years.
