The ironic thing about all this is he wants to be accepted as a woman and yet has absolutely no concept of the fact that women in the workplace have in general ACTUALLY had to face sexual/ emotional/ gender bullying, lower pay, slower career progression etc. he then gets to use his ‘protected status’ to steam roll another woman’s livelihood into the ground. They’ll never understand.
I was just chatting to Mr B about this and he asked me something I hadn’t actually considered.
Are employment tribunals covered by perjury laws in the same way as other court cases? I mean the minute Upton says he’s a woman in the witness box he’s knowingly telling a lie in court surely?

This has been covered/asked (but given no proper or legal answer) when victims of similar cases have been forced (as proper due course) to swear to tell the truth, but then judges force them to call men women and reprimand them for saying “he” and not “she”.
one case in the UK where a woman that got physically attacked by a transwoman, I think the woman’s name was Maria? In her 60s? She was physically attacked and then there was a court case and although she won, she was not awarded full costs she would have been because she refused to refer to her male attacker that punched her square in the face as a she and the judge told her off and said he was reducing costs awarded to her because of her reluctance
Having seen several of these cases specifically involving related cases it’s repeatedly the TRA side that are constantly bungling things, it pisses the judges off and they get irritated as the days go on, hence the snippy tones today
I’m not exaggerating either, every single one of these cases has always had duck ups only from the TRA legal side. Anyone remember Robin Moira White and the Bundle debacle? can’t remember what case that was? Maya’s?

Can anyone remember how the missing documents/emails came to light? Surely they would have noticed before now....but something is nagging in that NC said something earlier about something that came out in evidence yesterday.... I may have to have a trawl through this mornings tribunal tweets to see if I can find it.

If it helps, it was discussed at the very beginning of the tribunal which started maybe about 12? I don’t know if it was said how it came to light, and I did notice at the beginning there were sound dips (not sound issues) and I wondered whether it were confidential things, but it mostly went over my head and I was working. I was just hoping to hear Naomi’s questioning!
it was a late submission last night from NHS Fife side. They’ve been sending stuff in dribs and drabs this week and since the court order early Jan. The contents of the document they provided last night basically indicates that there must be other emails and documents available regarding the first, aborted investigation.

Ahh that makes sense, thanks for the update. I really cannot believe how incompetent NHS Fife are appearing in all of this, you would think with all of the noise around these types of cases that they would at least have got their ducks in a row. I expect there will be lot of people sweating this weekend. The IT guys and gals will be loving all the overtime they get paid for working over the weekend to track everything down.

I managed to get in on the live afternoon session so saw Naomi in action, I am busy rearranging my Monday diary so I can hopefully report on proceedings.
You’d think, but the NHS (not just Fife), and other employers, including universities and even legal firms(!) keep entering cases like this and pushing forward with them and spectacularly and embarrassingly lose yet continuously push on with them.
And I think I know why. It’s the same as why outdated bosses of companies think it’s best to let an 18 year old with “novel ideas” to handle the company social media account because “they’re young”.
Similarly, NHS don’t bother consulting with lawyers on this stuff because they have Stonewall reps and staff who’ve been taught by them who have advised them and can therefore represent them more on LGTBQ+ rights than what the actual law

Um, because you're a vindictive bleep who actually doesn't give a flying duck about anyone's safety but your own because you are terribly, terribly marginalised? And/or because there never was a patient safety issue? Who knows.
I hope Dr Beth suffers really bad menstrual cramps this weekend because she's mean.
