This has been covered/asked (but given no proper or legal answer) when victims of similar cases have been forced (as proper due course) to swear to tell the truth, but then judges force them to call men women and reprimand them for saying “he” and not “she”.I was just chatting to Mr B about this and he asked me something I hadn’t actually considered.
Are employment tribunals covered by perjury laws in the same way as other court cases? I mean the minute Upton says he’s a woman in the witness box he’s knowingly telling a lie in court surely?
Having seen several of these cases specifically involving related cases it’s repeatedly the TRA side that are constantly bungling things, it pisses the judges off and they get irritated as the days go on, hence the snippy tones todayWhat I’m finding fascinating about this is that because it’s not a criminal case we are seeing how legal discussions play out. It’s basically taken all bloody day to argue over missing emails and decide a course of action.

If it helps, it was discussed at the very beginning of the tribunal which started maybe about 12? I don’t know if it was said how it came to light, and I did notice at the beginning there were sound dips (not sound issues) and I wondered whether it were confidential things, but it mostly went over my head and I was working. I was just hoping to hear Naomi’s questioning!Can anyone remember how the missing documents/emails came to light? Surely they would have noticed before now....but something is nagging in that NC said something earlier about something that came out in evidence yesterday.... I may have to have a trawl through this mornings tribunal tweets to see if I can find it.
it was a late submission last night from NHS Fife side. They’ve been sending stuff in dribs and drabs this week and since the court order early Jan. The contents of the document they provided last night basically indicates that there must be other emails and documents available regarding the first, aborted investigation.Can anyone remember how the missing documents/emails came to light? Surely they would have noticed before now....but something is nagging in that NC said something earlier about something that came out in evidence yesterday.... I may have to have a trawl through this mornings tribunal tweets to see if I can find it.
Ahh that makes sense, thanks for the update. I really cannot believe how incompetent NHS Fife are appearing in all of this, you would think with all of the noise around these types of cases that they would at least have got their ducks in a row. I expect there will be lot of people sweating this weekend. Um, because you're a vindictive bleep who actually doesn't give a flying duck about anyone's safety but your own because you are terribly, terribly marginalised? And/or because there never was a patient safety issue? Who knows.Why wouldn’t you report a patient safety complaint immediately?
