It's absurd that all the correct documents aren't present. In my job I have to review documents, make decisions and write a report about it, and I wouldn't dream of proceeding without the full facts. And what I do is not as important as this!

After giving examples of lots of inconsistencies in documents received.

I hope the judge rips NHSFife a new one for this lack of proper disclosure. How can they possibly suspend someone and claim that there is no paperwork?

I’ve been following the MN thread too as there is a poster there watching online and providing details.
It’s still Naomi discussing with judge re nhs Fife deliberate defiance of court order. I guess she can’t cross examine without all info. She did get something at 9pm last night but not enough. So I don’t know what happens from here.
From what I can gather it’s the emails and notes between hospital staff doing the investigations into Upton’s complaints that are missing. Which suggests that they might show they never took a neutral position or followed their own policy. Stuff like that. If they did everything properly then they would have nothing to hide.

Having watched several of these cases online live, this seems to be a feature, not a bug or oversight…

Surely NHS Fife weren’t trying to scupper Naomi Cunningham and her team by deliberately withholding documents that might have informed her lines of questioning?

Best case scenario is that their record keeping was tit or none existent (which wouldn't surprise me in the NHS), worst case is that it's incriminating and they're deliberately obfuscating it. Neither reflects well on them though, does it?
If you're doing your job correctly and have nothing to hide, the documents should be freely available and nothing to worry about.

Isn’t it remarkable how well collected GC sides are in these hearings and the TRA side have continual problems. It’s almost like it’s hard trying to base a legal case on feelings and imagination and not law…
