Apparently she did get a fence installed around her whole backyard and that satisfied the law for fencing a pool with small children. It does come across as though she never intended to fence the actual pool itself, and hence she bought a katchakid pool net cover but it was rarely seen on the pool (apparently it takes 7 mins to recover the pool with one of these so probably would have been better with an automated one). They will have to live with that decision for the rest of their lives.
I do actually hope for Emilie's sake that her child's records are sealed. Her lawyer has stated that she doesn't intend to ever view the records (camera footage etc.) and so of course she doesn't want them out there in the public domain. Yes she put her life online but she still has a right to try to protect herself and her family from further emotional distress. The public knows enough information already - we know Trigg drowned and that prevention measures weren't being used. No one needs to hear 911 call recordings, or see body camera footage or autopsy findings of that poor child. RIP.
