The Judge will cover this point in his directions - it’s an important one. The same way that the defendant not taking the stand says nothing about guilt.I think most of us are aware of this being the rule now thanks to the legal brains on the thread. However, NJ has directly raised with the jury several times that they’ve had nothing to contradict his experts findings. He’s also raised several times how they’ve shown no actual evidence to prove the points that their case is built on, staffing levels, medical negligence, Gang of Four.
It’s usually reported when BM or the judge objects so personally feel the jury are being allowed to see the point that there is no real evidence coming from the defence. And I know exactly what I’d be thinking if I was on that jury! Rule or not![]()
Thankyou for thatManaged to find out what this post was about. Looks like what they failed to mentioned was the investigation that found no wrongdoing and the MP (or whatever he is) in question had 3 complaints put in about them for naming the doc and claiming it was parliamentary priveledge.
Feel better now I have the bigger picture.

It’s very hard to “prove innocence” because you can’t prove a negative. Unless you have a specific defence (for example self-defence, duress, an alibi) all you can really do is cast doubt on the prosecution case.It's all well and good saying the defence doesn't HAVE to prove anything, it's for the prosecution to prove their case, but if this was me and my life on the line, I think I would be producing any tiny scrap of proof that I could muster to defend myself! It's a bit silly to say "well, there was no need for witnesses because they don't have to prove she didn't do it, the pros just have to prove she did", because, no, if that was an innocent woman sat in the dock, why the hell would you not want to prove you didn't do it! I'd want to prove I was innocent by any means possible!

With her long face, obvious misery, and notes that question why me and say hate my life - I’ve thought the same. She had desires to do dreadful things and it seems she wished she didn’t. Of course ..I agreethey didn’t know until the investigations had begun about these babies. You are right, and I can see that there will be changes in the way labs report results to doctors as a result of this case (one of many changes) as essentially some blood results can take a week to come back because they are so specialised the machines or the scientists aren’t working full time. So what happens if these patients have been discharged in a weeks time? Ward doctors don’t check them because they’re not on their ward list - they’re just uploaded to the system to sit there unless there is someone in the lab who gets in contact with a medic who then follows it up/refers to GP to follow up. Occasionally abnormal bloods (in adults) might get picked up in outpatient clinic at the point of follow up months later. It’s definitely a problem with the system and although it is rare it does exist as we can all see.
What I will say is that it’s better to reframe the insulin blood tests at this point down the line, because the emphasis NJ is making plus the context of other ‘circumstantial’ evidence makes me believe that these blood tests will secure the minds that this is deliberate, with increasing motivation to harm or kill.
