But at some point in the period they were under 16 and that’s the part that could go forward now, especially if it’s the guy himself who raises it, rather than a 3rd party.If they were over 16 and there was no indication of a lack of consent then I would be pretty sure the CPS would say that it wasn't in the public interest to prosecute.
