He would be much better off legally if he had just given out away, IMHO (I am not a lawyer). Running an ad hoc lending scheme as a CIC seems really risky, financially and legally. Also donating money to random fundraisers.

In the kindest interpretation*, James is motivated by wanting to help people in need who are vulnerable. But as soon as you are doing that with other people's money through a legally recognised vehicle ( a CIC) you can't just do whatever you feel like doing. I can see it must feel frustrating to think that you're trying to help and be criticised at every turn, but there are legal and financial obligations that come with trying to do this kind of thing.

*I'm more leaning towards less kind interpretations myself, including buying a nice car through the business and showering himself in glory and media attention, but let's give him the benefit of the doubt
I am a lawyer and what he’s doing tells me he isn’t or he wouldn’t sleep for anxiety. He is so problematic it is unreal.

1. I do not like anyone who posts pictures, faces or not, of vulnerable people as part of so-called altruistic acts that are the exact opposite
2. I don’t care who this offends - it is naive at best to send money to him and his set up. There is literally no transparency, it’s just what he tells us and shows us. He could be doing his own shopping for all we know.
3. Frankly, I’d be livid if I donated money to pay other peoples baliffs. What a bizarre thing to. The legalities of that money lending plus FCA fines is something for him to consider, tax and interest implications etc.
4. He makes up some of those posts or loops them. It’s very obvious.
5. I find the whole concept of it very weird - does no one else? I’m paying for an unknown families boiler in Burnley on the back of what James says - they could be better off than me! It’s just weird. I don’t understand who donates apart from the vulnerable which is what bothers me.

CIC are the Chancers dream, Jodie marsh has One as well. It’s like a charity for thickos and/or con artists.

Charities are not easy or cheap to run but I’ve no qualms with larger charities who are open about it. I’ve no idea what James is running beyond a vanity product funded by the very people he purports to help.

Look at the Tom Moore fiasco - I will never forget his daughter at Wimbledon - you had leading scientists who sat With dignity whilst they were acknowledged. They mentioned her and she stood up to take an ovation!I knew then there was something off with her but look at what she’s done, perfectly legally, and it’s not uncommon. And don’t get me start on a 100 year old man walking laps for the NHS….

I know I sound like a miserable bitch but I get so pissed off at the amount of charity scams out there, it’s horrendous

Ofcom, 20 years young, who has #cancer, a #stoma, #gangrene and #leprosy, rang him up to personally tell him about the #1000 complaints they have received. They didn't #believe a single one and are #humbled by the #work #dephercphphcdecphercic do. They cried together on the phone, it was a very emotional time.

I probably don't have the full picture of what went down between Depher and BWC but I think I understand most of it. That they were calling him out early on and he went after them in an unhinged and aggressive manner that was blatantly tinged with racism. He also made false allegations that some of these women travelled to Burnley and damaged his store, which was not true.

I can understand these women have been badly treated and are now hyper-sensitive to anything to do with Anderson. I hope they get to tell their story because it's another important angle on this mess -- that Anderson is a bigot who has attacked people on the basis of race, as well as being particularly nasty about disabled people.

From my point of view, I think it was the correct editorial judgement for the BBC team to focus initially on the data breaches and exploitation of Depher's vulnerable clients. Because that gets to the heart of the problems with how this business has been operated and funded.

The BWC women and the other Twitterers who have been calling him out, as great personal cost in some instances, have done so much hard graft on this and they do deserve to be heard and credited for this unpleasant task. Perhaps this will come out in future coverage in the press. Fingers crossed.

Just watched the programme, about as much of a hatchet job as it could've been in the run time without getting sidetracked. Lets be honest they could have made a three hour long documentary if they had widened the scope beyond the misleading posts into other stuff.

Having read the BBC piece and watched the doccie, a few thoughts:
  1. It is right they focus on the safeguarding and exploitation of people who cannot give informed consent or were ignored, despite denying permission to publicise their stories. The repeated use of images to support fake stories as ways of begging money is egregious and must count as fraud.
  2. The fake noose posted with a link to a GoFundMe is just about the worst thing I've ever seen in a crowded space for emotionally manipulative grifters.
  3. The journos must push back on what happens to all the personal data Depher holds on its vulnerable beneficiaries. If a systemic data breach has occurred, what are the mechanisms to shut this down? What does the ICO say about this? Those individuals are no safer now but are even possibly more at risk of being targeted by other criminals now that there's a bigger focus on them in the media.
  4. The BBC touches on the shoddy work practices, focusing on the guy smoking on the job. However, there's so much more to this angle. Has Depher employed unqualified, unregistered workers who were allowed to do work unsupervised? Jimmy says he was present, supervising the smoking worker at the time -- why didn't the journos ask him whether he thought smoking was ok and why he filmed it and posted it? Is Depher doing work installing and repairing appliances they are unqualified to work on? How many other customers out there are unhappy with the quality of work delivered? The BBC even refers to Jimmy as a plumber when he is not one. What do the professional registering bodies think of this?
  5. Jimmy says in the film that he will return money donated if any donors ask him to. Apart from large individual sums (e.g. Hugh Grant and his unfortunate £75k), this is simply not possible to do. With all those crowdfunders, and people giving small amounts each, he may as well be trying to put air back into an unsealed bottle. So the journos should push back on this. It's not just a matter of returning money; it's the whole practice of how Depher goes about fundraising, using fraudulent tactics.
  6. The misleading accounts of the CIC should be deeper interrogated. The huge spends on generic admin (disproportionate to income and line items spending) are such a screeching red flag. How many staff are on salary and how many are sub-contractors? What is the real detail of Jimmy's non-wage? What about the massive director's loan? Are they really paying all the tax, NI and insurance they should be?
  7. The CIC regulator should be approached to comment on this. On the issues around governance, on financial reporting, on the restrictions around being a company aimed at a "social good". And what happens when it's gone wrong, as in this case?
  8. The BBC really should do a mea culpa and acknowledge its own role in giving this guy a massive platform in the past which boosted his income. As someone pointed out, the algorithms are already linking to past stories on the BBC platforms which praised Depher uncritically.
  9. It also should not be overlooked that Jimmy has form for deeply unpleasant racism, sexism and ableism. And he weaponised trolls who went after some of his critics in very sinister and threatening ways. It's not good enough for him to say he's sorry and made some mistakes.
  10. There's definitely some good opportunities now for consumer journalists to run some pieces about trends in online grifting and how people should learn to ask critical questions before they part with their money.

Blimey. You'd think even if he didn't technically need a DBS check (I've no idea if this is the case) he would ensure he and his workers would get one. Unless he can't for some reason :rolleyes:
And I'll never get over his complete disregard for confidentiality with his 'customers'.

I’ve mentioned on here before but my background is legal and a portion of my corporate days were spent in fraud, specifically around investigating individuals in various settings. The two categories, broadly, tended to be the stupid or the psychopathic. So incapable of doing things properly and mess up, or purposely do it but there is a specific game plan. Then you have the rare few; the absolute True Con Man. There is no logic, it becomes more reckless, there are several motivations on the go and crucially - they will not stop and are a million times harder to pin down. There seems to be some sort of perverse joy in the whole thing for them, and massively compulsive behaviour. This is why I have always been so resolute in the con man argument with James. I have met his sort before and they are bloody terrifying when let loose, as we have seen repeatedly.

The reality is that without a specialist team (I can only hope Lancs Police have a good one), and a bloody determined lead investigator, justice will not be done. This absolutely needs looking at as a serious criminal matter and I wouldn’t be surprised if he is being talked about by the Vulnerable Adults Team in the local authority. He targets vulnerable people and had admittedly taken money he shouldn’t. He is a bloody crook.

And just as a side note, whilst I remember, as my fella made a good, basic point whilst I was getting enraged by the details - if James loves Depher so much, if he cares so much about the work - why wouldn’t he just step away completely? He has completely poisoned the well and it gets worse the longer he stays. No shame at all.
