I went down a rabbit hole today for my own curiosity and had time on my hands I did find some interesting information. General information under family law child support and visitation/custody are two completely separate issues. A custodial parent cannot legally withhold court-ordered visitation as leverage to force the payment of child support in the arrears.
So my next step was NJ family court and NJ has specific legal standards, statues, and court rules that dictate how judges handle this exact situation.
A case that is in New Jersey strengthens the father’s position bc NJ law explicitly separates child support and parenting time. A residential parent cannot use the withholding of visitation as a tool to collect debt.
So NJ legal standards the best interest of the children N.J.S.A.9;2-4 withholding the children strictly over money violates this principle.
Cory would need to file a Motion to enforce Litigant’s Rights but also gather proof she blocked him, screen shots of not responding to text etc…that’s where we come in to gather information to send to Tara.
She is a real bitch and Cory deserves justice bc the more this goes on the worse it will get…and that is what the court is saying.
