Ok, so send the below to https://ico.org.uk/make-a-complaint/data-protection-complaints/
Dear Sir or Madam,
I am writing to you to complain about the conduct of a business in regards to my personal information being shared without legal basis for doing do.
I am a mother of young children and follow the social media channels of a business named "Swans and Bluebells" (https://www.swansandbluebells.com/ ) and (https://www.instagram.com/swans_and_bluebells/?hl=en) which deals in e-commerce of baby clothes and items. I really liked the aesthetic of the items which Swans and Bluebells sell, and in the future would likely have purchased from this store for my own children.
Whilst recently browsing on Instagram for leisure purposes, I noticed that Swans and Bluebells had enlisted an influencer (who is employed as a sole trader to post advertisements for businesses) by the name of Rebecca Lamb (https://www.instagram.com/rebeccaellenlamb) to undertake a collaboration with them.
It is fair to say Rebecca Lamb is somewhat of a nefarious character - During the pandemic she rubbished the covid virus as "hyped up media crap", has enabled her partner in publicly posting racist messages which has led to other brands and even her one time management dropping her from campaigns previously - but most shockingly has appeared in videos on the adult website Pornhub, despite marketing herself as a "mummy blogger."
Had I personally owned a company dealing in the retail of baby clothes, it is fair to say that Rebecca Lamb would not be the sort of person I would want to promote my brand. For this reason, I naively assumed that the owner of Swans and Bluebells was unaware of her past activity and sent them a short polite message to bring this to their attention. I was under the impression that my message was confidential between myself and the business, as would be the expectation for a complaint raised with any professional organisation. A hotel owner couldnt just demand that TripAdvisor hand over personal data on an individual who had left a negative review, to give an example.
I then received a reply by Instagram direct message from Swans and Bluebells which was rather angry and condescending in tone. Whilst I believed the tone of the response to be slightly unprofessional for a business, it is what happened next that has caused me grave alarm.
Rebecca Lamb (the influencer, who has appeared on PornHub, and the subject of my complaint to Swans and Bluebells) and her partner (the one who has publicly posted racist viewpoints) have contacted me from both of their personal instagram accounts, with Rebecca threatening to post details of my social media to her 69,000 instagram followers for being a "bully", in daring to give feecback to a business regarding using someone with her past record to promote baby products.
To provide some context, I do not choose to live my life in the public eye and have only [INSERT NUMBER OF IG FOLLOWERS YOU HAVE HERE] , comprised of mainly family and friends. Therefore, the only logical conclusion as to how Rebecca Lamb and Steven Walter Hobson (https://www.instagram.com/stevehobson) came across my instagram handle and message me in this way, is that Swans and Bluebells made them aware of our earlier private communications and that my viewpoint of Rebecca wasnt entirely positive. Swans and Bluebells have then presumably provided my social media details to Rebecca and Steven Walterm which they have then used to threaten to publicise my personal data to the 69,000 people who are followers of Rebeccas public instagram account.
I do not believe that as a business and a data controller, Swans and Bluebells had any lawful basis upon which to hand my information over to Rebecca Lamb (another sole trader business) and Steve Hobson. This has now put me at potential risk of harm solely because I chose to complain about a marketing choice made by Swans and Bluebells. I did not provide my consent for my instagram account to be disclosed to Rebecca, it is not in the public interest for Rebecca to have my personal information, my personal social media account details aren't required for performance of a contract between Rebecca Lamb and Swans and Bluebells, there was no legal obligation for Swans and Bluebells to provide this data to Rebecca Lamb and so on, and so forth.
I could not find Swans and Bluebells, or Rebecca Lamb, on your register of fee payers, but even if these businesses are not required to be registered with the ICO they are still required to process any data in accordance with the parameters of the General Data Protection Regulation (2018). I believe that on this occasion there have been gross breaches of Principle (a): Lawfulness, fairness and transparency and Principle (f): Integrity and confidentiality (security).
With the above in mind, I would be grateful if you could investigate this incident and take this up with Swans and Bluebells and Rebecca Lamb as appropriate. Please do not hesitate to contact me if you require any further information.
Yours sincerely,
{NAME]
Make sure you attach screenshots of your messages with shit and bollocks and dingle and walt, a screenshot of your own IG profile showing number of followers etc would also be helpful.
