As a woman, if another woman had a heavy period & was embarrassed about it & asked if I'd leave the room to give her some privacy whilst she changed, I'd do it in a heartbeat & wait outside. The transgender doctor at the centre of the NHS Fife employment tribunal has denied telling a “pack of lies” to get a nurse who disagreed with her using the female changing room sacked.
Dr Beth Upton was accused of making up incidents including an allegation nurse Sandie Peggie had abandoned a patient because she did not want to work with Dr Upton.
Ms Peggie was suspended by NHS Fife following a row on Christmas Eve in 2023 when she confronted Dr Upton about the two sharing a changing room.
The A&E nurse, who worked at Kirkcaldy’s Victoria Hospital, is suing the health board and Dr Upton.
“You have done your very best to end Sandie Peggie’s unblemished career as punishment, haven’t you?” lawyer Naomi Cunningham asked.
‘I stood my ground’
But Dr Upton said: “I am not interested in having Sandie removed from the workplace.
“It’s not about punishing her for standing up to me when I harassed her, because I didn’t harass her.
“She harassed me and I stood my ground and tried to diffuse the situation”, Dr Upton said, referring to the locker room incident.
Dr Upton also denied wanting to punish the claimant, instead describing a complaint as an attempt to seek a “just and peaceful resolution to what could and should have been a workplace dispute”.
Sandy Kemp, the judge presiding over the case, has said it is almost certain not all evidence will be heard by Friday as scheduled.
And it could be July or later before the parties are able to return.
Speaking at the end of her cross examination on Wednesday, Ms Cunningham said Dr Upton’s punishment included lying about Ms Peggie asking what her chromosomes were.
“What you were doing was telling a pack of lies to get Sandie dismissed,” she added.
“That was a pack of lies, which if anyone had believed them, could have got her not merely dismissed but also struck off as a nurse,” the barrister said.
Ms Cunningham also accused Dr Upton of prioritising gender identity over patient safety.
She asked why the doctor did not immediately raise concerns over Ms Peggie’s alleged conduct with a patient when the incident occurred.
Dr Upton described being unsure why Ms Peggie had left the patient after the incident and thought it might have simply been a “communication issue” at the time.
Dr Upton said it was only with the context of the Christmas Eve encounter that it became clear it was due to the doctor’s transgender identity.
Ms Cunningham repeatedly referred to Dr Upton as a man during her cross-examination, despite the medic identifying as a woman.
Judge Sandy Kemp, who presided over a pre-tribunal hearing on January 21, previously ruled Ms Peggie could refer to Dr Upton as a man.
Third day of cross-examination
In one fiery exchange, after being asked if the demand for this identity to be respected would jeopardise patient safety, the A&E doctor said: “You don’t like me very much, if you were to collapse now with a heart attack I would treat you.”
The tribunal was briefly interrupted after Jane Russell KC, the lawyer representing NHS Fife and Dr Upton, claimed she heard someone “mocking” the medic from the public gallery.
The judge was forced to intervene, telling those present they could be removed.
This was the third and final day of Ms Cunningham’s cross-examination.
On Tuesday, the barrister had accused Dr Upton of participating in an “immersive role play” by wanting to use the women’s changing room.
The hearing later descended into chaos as online viewing was suspended due to interruptions and a further row over documents erupted.
The tribunal continues.

From memory, this is what happened.
Dr Upton made notes on his phone each time Sandie Peggie found him in the female changing room, left and waited outside until he also left the room. Presumably he believed this to be evidence of her transphobia which is why he recorded it. The Supreme Court ruling has now clarified that Dr Upton (as a man) should not have been inside the single-sex women's changing room.
An alleged incident happened. Dr Upton claims that Sandie walked out on a patient he was treating, and that this was solely due to her refusing to work with him as a transgender. However, he didn't follow hospital procedure and report this incident immediately.
At Christmas Sandie rushed to the changing room during her shift as she had experienced a menstrual flood and needed to quickly change her scrubs. She found Dr Upton in there, and unable to wait for him to finish and leave she asked him to give her some privacy and leave. He refused and an argument followed.
Dr Upton then reported the above incident, claiming that Sandie walked out on a patient. Sandie was suspended as a result pending further enquiries. I believe that Fife didn't follow the correct procedure when suspending Sandie, it's possible they should both have been suspended until the matter was resolved. (I know very little about how it works, and may be wrong about this).
As I said, this is from memory and I'm happy to be corrected.
ETA: plus I'd not mention it to anyone else & not mention it again yo the woman in question either. Periods are normal & happen to most women, but it's also private & nobody else's business.

Why don't you go? Your money (that you cash in when you sell your home and car etc)* will go so much further, too in a country where the average wage is about £150/ month. Oh ffs. "Inclusive language". Which excludes women, as it is only women who can get pregnant. People don't. In the same way "people" don't get prostate cancer, only men do. It's actual biology & a scientific fact, you'd expect the media, especially the supposed bastion of news & current affairs to report accurately. I hate the term “the gender critical movement”. It’s not a movement, it’s what everyone believed not that long ago. I’ve just never changed my opinion. Never believed that people can change sex and always thought that trans women are men. Being totally honest, always found them creepy too, the whole fact that an adult male wants to appear like an over sexualised female or a little girl just sets off some deep rooted visceral warning in me. Like you @Vanelope, I’m a realist and cannot put daft ideologies over scientific fact.
I also loathe the assertion that everyone has a gender identity. No I don’t. I just am. It’s like TIM saying they “feel” like a woman. How do they know what a woman feels like? Said this before, but I only know what it feels like to be me, I can’t speak for anyone else. We’re not all one homogeneous mindset that all like the same things.
If I never heard the word “gender” again I’d be delighted.

Very interesting. Another thing, when I was a child, we repeatedly got talks about safety, strangers, trusting our instincts and being aware of men acting suspiciously or creepily. Now, all this TWAW, “be kind” ( oh how I hate that phrase) don’t stare etc, we are telling women and girls to ignore these instincts that are hard wired into us. Reality is blurred when the absolute basics of what a woman and what a man are is somehow suddenly a matter of debate rather than fact. Ignoring our discomfort about men disguised as women and behaving inappropriately ( I’d consider a TIM using female facilities as inappropriate) is dangerous and wrong. It’s trying to suppress a basic survival instinct.

It's like that old saying, the devil makes work for idle hands. People nowadays have so much leisure time, and a lot of young people especially, hardly work at all, so they have literally nothing else to do but trawl through the online cesspits, looking for somewhere to fit in. They're terminally offended, if theyre not moaning about JKR and the terfs, they're whinging about the environment, (although paper straws are a step too far apparently
) They shout loudly about Gaza, whilst knowing nothing of the history of this troubled region. They march for "Pride" but expect gay women to have sex with trans identified men.
They're loud but they honestly have nothing new to say.
I can remember marching against the Poll Tax, and for the miners. I've always voted, aware that it's a privilege not given to all women.
What are they ranting for today? For women to give up their rights to single sex spaces, and for transvestites to beat the shit out of us in contact sports. Thanks for nothing

so in an effort to get me doing something/anything, I started a stand up comedy course last week.
it’s actually been quite fun so far, and I’m enjoying getting to be creative and seeing how other minds approach the same role play tasks etc.
the people all seem pretty normal and there’s variance in age, sex, race and (based on vibes) sexuality. However there are of course one or two verryyyyyy annoying “pick me” types who you’d expect to find on a course like this.
One of them is the course leader (lol). She actually seems like a perfectly lovely and intelligent woman just as she is, but she has that mad paranoid self-righteous self regard where she’ll randomly bring up things like racism for no real reason.
Like last week, she asked as to write down a list of 10 things we hate, and as we were writing she said “if you haven’t written down racism yet then that’s a red flag!” This woman is white btw. Yesterday she was obsessed, I think it’s a bit of a nervous tic for her, and she ended up backing herself into a corner where she was explaining racism to a mixed race woman. She’s also pushing 50 so the paranoid vibes are v odd, imo - though people like that are like catnip to me as I love to tease.
Yesterday we had a bit of a back and forth, as she was talking about all the abuse she gets online for being ‘political’ (cue another eye roll from me - I’ve looked at her Twitter, her posts get one or two comments, some of which are very cruel, but the overall engagement is next to none - her YouTube comments are switched off). She said that when she looks at “these people’s profiles, it’s always men in a MAGA hat” and something along the lines of “if you think I’ve disrespected your religion then I don’t care because I think your religion is stupid.”
I tried pointing out to the room that, as much as we might not like MAGA, if she has the right to go on a public platform and slag off x/y/z religion, then religious groups also have the right to respond. That’s how freedom of speech, and belief, works. Also baring in mind she doesn’t know if any of us there are deeply religious!
Naturally, the conversation then descended into nonsense one-upping within the group, until the coordinator tried to regain control by saying “none of this matters because none of you are going to do controversial sets! Please nobody do anything on trans rights, I’m not MCing a show on trans rights!” LOL why?! Because you clearly can’t handle it?!
The other annoying person is a woman in her early 20s who in the first two weeks has interrupted the session multiple times to self-reference her: alcoholism; autism/adhd/bipolar; ‘hatred for binary thinking’; sexuality/coming out. To be clear, I find this behaviour irritating because my impression is that she assumes she’s the only one in the room who might be struggling with these issues, whereas if she’d been paying attention, she’d realise they’re all probably quite unifying traits among the group. We’re just adults who don’t define ourselves according to whatever label we think is going to get us the most attention that day.
Anyway, at one point one of the more effeminate men was in the middle of the room doing a role play task, we had to heckle him, and the annoying girl called out “you’re not straight!”. I’d wager she’s probably right, and sure it was quite funny, but the hypocrisy was funnier to me! This man hasn’t told us anything about his sexuality, and he also ignored this comment from her (I’d have retorted with ‘and you’re not funny!’), so why is it okay for her to ridicule someone for their perceived sexuality, but if I made the same joke wearing a MAGA hat, I’d be bigoted? I’m not pro MAGA btw, and I’m gay!
Anyway, I’m gonna have fun needling these supposed progressive liberals over the coming weeks. I’ve already written my GC set for the showcase
