End my tenancy, but I’m having trouble.

I live in a HA property, long story cut short, we’ve had problems with a malicious neighbour since May-2019, this includes social services, education welfare officers, police, fraud... the list is endless. I’ve also been issued as ASBO for what they’ve even said is “petty complaints.”

The council have offered me a new house which I’ve accepted. But my old HA have not accepted the end of tenancy email as they wish for me to speak to the housing officer & also the senior management team as to why we are leaving, I’ve happily quoted all the police crime references numbers like I did in each phone call & email. I’ve also spoken to THREE housing officers to no avail. I’m not going to be held responsible for rent on a property we will not be living in, but my reason is more than fair.

Can anyone help me, why should I need to speak to the Senior Management team? Do I tell them exactly what I’ve already told the housing officers or shall I just hear what they have to say maybe an outcome? We wouldn’t be moving if the malicious neighbour was to leave, but it hasn’t worked out that way. Help, plz. Advice if any. Thanks all.

They cannot reject your notice, provided it’s in line with your tenancy agreement there is nothing they can do. You should not have to for a reason either.

What exactly is their reasoning? I would put it in writing (letter) and send it signed for to their office stating you are giving notice as per
Clause X of your tenancy agreement. State your last day, that by return you want a date and time for you checking out appointment. Do not give them options.

I would also seek the assistance of the housing team for your new property and possibly citizens advice.
 
Surely moving elsewhere is reason enough to provide notice?
As long as you give notice according to your contract. Can you phone or email citizen's advice,
 
Are you sure that it's to force you to stay? The HA has a duty to you so maybe senior management want to speak to you to see how/if they can resolve the problems.

If you have given notice in line with your tenancy agreement then there is nothing they can do! Make sure you cancel any rent standing orders or housing benefit

They can't refuse your notice to terminate your tenancy. A HA can't force you to remain their tenant and why would they? They'll have a queue as long as your arm for someone to move in when you've gone. As long as they accept emails to end your tenancy you'll be fine although you may want to pop it in the post. As for handing your keys in, you'll need to do that at your local housing office. Meeting with the senior housing officer may just be to ensure you are ok after the history with your neighbours.
 
I would speak to them. Because you’ve said in your letter you’ve highlighted serious issues that haven’t been addressed, they may just want to discuss that with you. As has been said before, they can’t force you to stay snd they’re unlikely to try and persuade you.

Plus this might give you an opportunity to be heard on what’s happened.

I have served notice and a manager called. No complaints have been made against me but it was up to me to end my tenancy.
