hi all! i know there are a lot of SEN mum’s on here, I don’t mean to derail the thread at all but can someone please point me in the direction of an SEN advice thread please, my son’s nursery aren’t following his EHCP and are just letting him run riot all day which is severely affecting his behaviour and i need advice asap, tia x
 
Hello! I’ve worked in SEN for over 10 years. Different counties have different processes when it comes to EHCPs. Have you anything within the county that can support this? You could go direct to the SEND team that issued the EHCP?

An EHCP is a legally binding document so they have to follow the provision stated

I dont know if there is a sen thread on here but you could call for an emergency review, like his annual review. You can complain to the LA and school but that might end up with them being funny with you, whereas the emergency review may solve everything without doing the complaints route. Look on ipsea.org.uk and sossen.org.uk about emergency reviews, I think they have a helpline too or you can book a telephone appointment for advice.

How old is he? You can write to your LA and threaten them with a judicial review for failure to provide. You have to not worry about the LA or the school being ‘funny’ with you. The judicial review would be your child vs the LA, so you’d get legal aid in his name.

Do you have a local SENDIASS service? Look them up and see if one in your local area you could chat with first. Get a copy of the ehcp and highlight everything in section F that they should be supporting. It is a legal document so they must follow whatever is stated in there. I’d also suggest any meetings bring someone with you. I’ve used IPSEA helpline before you have to go online to book a slot keep looking back as those slots book up fast but new ones added. Sure it’s only a half hour slot. Well, last time I used it was like that anyway. IPSEA website is useful.
