Disability discrimination at work

Has anyone on here experienced disability discrimination in the work place?

I’m having a bit of a mare at the moment with my employer, I work for a well known Clothing shop (retail). I have scoliosis which they are aware of and having more tests as I’m having some serious nerve problems on my left side, which I’ve made them fully aware of.

basically after our store reopened due to Covid. I was put on the front door counting in and out customers, the standing onthe spot for 4 hours was agony. So they got me a chair for the first week this was fine with the main store manager.

but the second week the deputy manager was back and spoke to me really patronising in front of customers claiming that it was rude, unprofessional and unengaging despite chatting to every customer that entered the shop! I explained that I was in pain her reply was “what at this moment? Why are you here then?” Then proceeded to tell me that if I needed a chair it would need to be hidden behind the tills where customers can’t see.

I was so upset luckily it was near the end of my shift.

next day I went in and I was on the front door again in our work briefing with other staff and a different manager I asked if I could swap and told her about the day before what had happened. She basically shouted and belittled me in front of my colleagues that I shouldn’t be using a chair.

I then calmly said “if I was in a wheel chair you wouldn’t be saying that”

her reply “holly people in a wheel chair don’t have a choice But to have a seat, you do”

since then work has been extremely difficult and I have now been signed off as I am in agony just standing for a few minutes aswell as getting constant jolting/tremors in my left leg and right arm.

I get no disability benefits for my conditions something now I’m unfortunately looking into, I never thought I’d be like this at 29.

By law your workplace have to make reasonable adjustments to allow you to do your job. I'm so sorry to hear that your managers have been humiliating you in front of colleagues and customers. That's completely unacceptable. Have you contacted Citizen's Advice? They should be able to point you in the right direction.

I'm also sorry to hear that you are in so much pain. I hope that the tests can shed some light on your nerve issues and the doctors can help you feel better.

I think you should seek advice from a union if you’re a member or ACAS. You shouldn’t be having to put up with that at all. I have been through mental health discrimination at a previous job (in the NHS of all places) - I had some time off because I had a mental breakdown but returned. My manager wouldn’t make reasonable adjustments e.g I requested reducing my hours slightly and better working environment (I was practically in cupboard with a desk whilst other co-workers were in a large office and could chat etc). It was horrible so I soon left. Hope you manage to feel better soon x

The Equality Act 2010 sets out what your work is supposed to do for you as @skvallertant said above. There is a solicitor on Twitter called Chris Fry (specialises in disability) at Fry Legal you could contact. I noticed that he was actively helping disabled people at home who were excluded from food delivery slots at the beginning of the pandemic. He was writing letters to all the grocery stores.

You say you work for a large company so approach the HR department, it's just not acceptable.

Use the gov.co.uk web site, they have lots of information to help. And as above The Equality Act 2010 should give you guidance.

Join an union and get in touch with them, explain the situation they will come out and support you in meetings etc

To add to this, never, ever go into a meeting alone, especially one of this nature or a disciplinary. It might seem silly, but you need a witness who is on your side. Preferably a union rep, but in a pinch, just anybody.

Hi everyone thankyou for all your replies really is appreciated.

I’m with a union and yesterday phoned them and they want me to raise a formal grievance which I will. I’m just a bit nervous as this happened in August and I’ve been signed off since then I’m worried they are going to think why am I Bringing it up now. But I’m due to go back end of next week but I’m anxious about the whole situation because of what happened.

regarding to HR, completely unbelievable I know. But I’ve tried to contact them before, but I couldn't talk To anyone and was told our HR is in store. They wouldn’t put me through to anyone or give me any contact numbers

I had some disability issues at work a few years ago and found the Equality Advisory Support Service helpful.
I'd also suggest getting an Occupational Health referral to back up any reasonable adjustments you ask for.
While by law your employer does have to make reasonable adjustements their idea of reasonable and yours will most likely be different! A lot of the adjustments I asked for were refused as they wouldn't meet business need, I was also told some would seem unfair for my colleagues even though the adjustments would have brought me up to me more equal to them not the other way around!

Do not ever let them gaslight you into backing down or worrying about what they think. You’re signed off work because of them. They failed to make reasonable adjustments under the equality act, if you ever take that to an employment tribunal a judge can impose a £20k fine just for not upholding the equality act. You are not the first or last person to go through this disgusting treatment and don’t let them get away with it ❤
All the suggestions as before a the right lines! It’s not your fault that society disables people!

Get legal advice, ring acas, don't let it drop though you've been treated appallingly and denied what you are entitled to by law (the right to request reasonable adjustments). You could take this all the way to tribunal if you get good advice now and follow your company's grievance procedure correctly. Contact them and ask for a copy of the grievance procedure to be sent to you in the post ASAP, then log the grievance, ALWAYS take someone with you to meetings (your union rep might be be able to attend with you), get legal advice at each stage of the procedure. And for now while you've got any time on your hands at all read everything you can about the equalities act, reasonable adjustments etc. Acas' website has fantastic resources on, I'll try get some links for you x

Honestly the acas website has everything you need to know to fight this.... Read as much as you can, teach yourself the law, get legal advice from union/solicitor/citizens adv/acas helpline and go fight it 🙌😅

I hope things work out for you. I just got a new job under same main company and in my previous role they knew all about my disibilities (invisible) but failed to pass it on to new role 🙄 Ive had two hospital admissions in last 2 weeks and work are making it really awkward and have extended my probation because of “sickness”
it’s a horrible feeling

Good luck :). I pulled ligaments on my left foot, same one I'd damaged six months before (a bleeping toast made me jump and land on my damaged foot). My work at the time was in museums, long days on my feet, but my boss wouldn't let me sit down at all (she even expected me to take two buses in when I couldn't get in after it happened to do the finances for a week). They were also dreadful with my mental health, and I'm a mental health advocate! Strangely, last week I had a meeting with my work after I had filed a formal complaint (a page and half typed) on how badly I'd been treated and awful things I'd witnessed. I'm changing careers from Monday, retraining, and feels right.

Just wanted to hop on, hello fellow scoliosis friend! I have scoliosis, wore a back brace throughout my teenage years (im 31 now). I just wanted to let you know that there are some good employers out there who don't discriminate and will happily make adjustments for you! I domt want to just assume but don't think you won't get employed elsewhere because you 100% will. I know with the current economic climate its not the time to be looking for jobs but maybe something to consider in the future!, you deserve better! My current job is actually the first place I've been honest and upfront about my conditions as its always something I felt I had to "hide" as I was worried i wouldn't get the job or would be judged.
I hope you aren't in too much pain tonight, im in bed with my heated blanket and pregnancy pillow (even though I'm no longer pregnant 🤣 its so comfy!) Xxx
