Wondering if anyone can help! There is a local independent shoe shop near to me ,one of the few, and this is the second time I've been refused a refund. The first time the shoes were faulty and I was "accused" of breaking them myself! After 40 minutes of being talked down I excepted a credit note (I eventually bought something a year later out of worry the shop may fold) This time I bought a well known Australian brand I'd been eyeing up as boots for general use, walking the dog etc and went and tried my size on, I was wearing thin tights, so as they didn't feel tight/small bought them, and the assistant said they'd fit better with socks and I was welcome to return them if they were wrong. I got home tried them on and they were still too big. I looked on this brands website and it says as these shoes are unisex that women should size down. So my 5 were a size 6. Took them back as I felt they were mis-sold to me and they didn't have the correct size to swap with, couldn't order any, then they refused a refund. So I'm £150 pounds down if I want to get these boots. I don't need any other shoes and most that are stocked that I like I already have! Can anyone give me advice as to what I can do? I'm really upset.
 
I believe the shop doesn't have to offer a refund.

A lot of places will do exchange/credit note only. So I don't think you have much chance of fighting it.

Could you not just try and sell the boots on marketplace or something for a slightly lower price? Then at least you’re not too out of pocket

Legally they don’t have to offer you a refund.

Cut your losses and just sell the boots on Facebook marketplace or eBay or wherever, and don’t buy anything from this particular shop ever again.

@knickerbocker glory - You may have the right to a refund under the Consumer Rights Act 2015 (as long as you returned the boots within 30 days). After 30 days you could not insist on a refund but could ask for a replacement (credit note) instead.

The argument would be that you relied upon the expertise of the assistant that the boots would fit when wearing socks and because they did not they are 'not fit for purpose'.

Hi, thanks for your replies! I contacted the brands UK customer services. I explained what had happened and that I was refused a refund, they wouldn't order a pair and that I had this credit note for a large sum £, they were so apologetic and shocked. They sent me out a pair that day, they said they would speak to the shop about payment. Really rate this brand and they went above and beyond to help me. So nice when this happens!
