Children’s passport without consent from father?

He probably would be bitter about it and said he doesn’t trust me. No idea why.
I have a home here, a small business, all my family and friends, no one I know lives abroad either and to up and leave and never come back I’d need to win the lottery!

End of the day parents like that need to think on how they’re actions effect they’re child, why should your child miss out on holidays just because his other parents bitter, so sad! Hopefully you can go

I am estranged from my children's father, he was abusive and finally got free in 2020.

I went to Spain this year, applied for passports with no issue. I took their birth certificates but no one asked a thing. My children have their father's surname too.

I am intending to go through the court to get a parental order to be safe. I have no address etc for him so couldn't ask him for permission if I tried.

Thankyou! I'm well on the other side now, with a loving partner who treats my children like his own I was lucky to get away, and manage to put it to the back of my mind most days until situations like this rear their head!

If the father Has gone to court and sought guardianship you will definitely need his signature and he’ll have to go to guarda station to sign it with you. If you were never married and he’s not a legal guardian you don’t need permission. I would put it in an email to him with dates and length of trip to cover yourself. I know all of this from first hand experience. His legal ‘team’ would only want confirmation that your not going to live abroad and it’s unlikely to come to that. My advice is put Everything in writing.

That’s the same as me. Just go ahead and get passport and if guard asks say you’re sole custodian. That’s what I did last month and was all above board. Enjoy the holiday
